1. Agreement
These Terms of Service ("Terms") are an agreement between you and Curvy Coder, LLC, a Florida limited liability company ("we," "us," "our"), which operates the Crow Friends mobile app and the crowfriends.app website (together, the "Services"). By downloading, opening or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Who can use it
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian, who agrees to these Terms for you.
3. Your license to use the app
We give you a personal, non-exclusive, non-transferable, revocable license to download and use the Crow Friends app on devices you own or control, for your own non-commercial use, under these Terms and the rules of the app store you got it from.
You may not copy, modify, resell, rent, reverse engineer or make derivative works of the app or its content, except where the law expressly allows it.
4. Your content
The crows, notes, photos, videos and recordings you add ("Your Content") belong to you. Your Content is stored on your phone, and we do not receive it.
Because Your Content lives on your device, you are responsible for keeping a backup. The app includes an export feature for this. If your phone is lost, reset, or the app is deleted, we cannot recover Your Content for you.
If we later offer an optional feature that sends any of Your Content to us, such as cloud backup or sharing photos with our social accounts, we will explain it and ask for your permission in the app first.
5. Subscriptions and purchases
Paid through Apple or Google
Crow Friends is a paid app. Purchases and subscriptions are sold through the Apple App Store or Google Play and are processed by them, under their terms. The price is shown in the app and in the store before you buy.
Automatic renewal
Subscriptions renew automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Your Apple or Google account is charged within 24 hours before renewal.
Cancelling
Deleting the app does not cancel a subscription. To cancel:
- iPhone: open Settings, tap your name, then Subscriptions, then Crow Friends.
- Android: open the Google Play Store, tap your profile picture, then Payments and subscriptions, then Subscriptions, then Crow Friends.
When you cancel, you keep access until the end of the period you already paid for.
Refunds
Refunds are handled by Apple or Google under their policies. Apple: reportaproblem.apple.com. Google Play: request it from your order history in the Play Store. We cannot issue refunds for store purchases directly.
Price changes
We may change prices. If a subscription price goes up, Apple or Google will notify you as their rules require, and you can cancel before the new price applies.
6. Wildlife, safety and the law
Crow Friends is about wild birds. Please keep them, yourself and your neighbors safe.
- Follow the law where you live. Rules about feeding wildlife vary by country, state, province, city, park and homeowner association. In the United States, crows are protected under the federal Migratory Bird Treaty Act, which generally makes it illegal to harm, capture or keep them, or to keep their feathers, nests or eggs. It is your responsibility to know and follow the rules that apply to you. The rules information in the app is a general guide, not legal advice.
- Keep wild birds wild. Do not try to capture, keep or tame a crow. Never handle a sick, injured or dead bird; contact a licensed wildlife rehabilitator or your local wildlife agency instead.
- Feed responsibly. Offer small amounts, keep feeding spots clean, and pick up leftovers so you do not attract rodents or bother neighbors.
- Protect yourself. Wash your hands after handling feeders or food. Crows can be protective of their young in spring and summer.
You use the Services and interact with wildlife at your own risk. We are not responsible for any injury, illness, property damage, dispute with neighbors or landlords, fine or other consequence arising from feeding or interacting with wildlife.
7. Guide information
The guide content in Crow Friends, including foods, behaviors, sounds, species, seasons, trust milestones and local rules, is general educational information. We work to keep it accurate and show how well supported each claim is, but crows are wild animals and science is still learning about them. The information is not veterinary, medical or legal advice, and the time ranges shown are typical experiences, not promises. If you spot a mistake, please tell us.
8. Acceptable use
You agree not to:
- Use the Services to harm, harass, capture or illegally keep any animal.
- Break any law, or help someone else do so, using the Services.
- Interfere with, hack, overload or try to gain unauthorized access to the Services.
- Get around purchase restrictions or share paid access in ways the app store does not allow.
- Copy, scrape or redistribute the app's guide content or images.
9. Our intellectual property
The Services, including the app, its design, text, images, illustrations, logos and the Crow Friends name, are owned by Curvy Coder, LLC or its licensors and are protected by copyright, trademark and other laws. "Crow Friends" and the Crow Friends logo are our trademarks. Nothing in these Terms gives you the right to use them.
If you send us suggestions or feedback, we may use them without any obligation to you.
10. Third-party services
The Services rely on third parties, such as Apple, Google and the providers listed in our Privacy Policy, and may link to outside websites and sources. We are not responsible for third-party services or websites, and your use of them is governed by their own terms.
11. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Services will be uninterrupted or error free, that any crow will visit, trust you or bring you anything, or that Your Content will never be lost.
Some places do not allow certain warranty exclusions, so some of these may not apply to you.
12. Limitation of liability
To the fullest extent the law allows, Curvy Coder, LLC and its members, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, profits or goodwill, arising from or related to the Services or these Terms. Our total liability for any claim is limited to the greater of the amount you paid us for the Services in the 12 months before the claim, or $50.
Some places do not allow these limits, so they may not fully apply to you.
13. Indemnity
You agree to defend and hold harmless Curvy Coder, LLC from claims, losses and costs (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or your interactions with wildlife, other people or property while using the Services.
14. Ending these terms
You can stop using the Services at any time by deleting the app. We may suspend or end your access if you break these Terms or if we stop offering the Services. If we discontinue the app, we will try to give reasonable notice so you can export your data. Sections that by their nature should survive, such as sections 6 and 9 through 16, continue after these Terms end.
15. Disputes and arbitration
Talk to us first. Most problems can be solved quickly. Before filing any claim, email us at admin@crowfriends.app with a description of the problem, and give us 30 days to try to resolve it.
Binding individual arbitration. If we cannot resolve it, you and we agree that any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies.
You and we each waive the right to a jury trial and to participate in a class action or class-wide arbitration.
Opting out. You may opt out of this arbitration agreement by emailing us within 30 days of first using the Services, with the subject "Arbitration opt out" and your name.
16. Governing law
These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict of law rules. For any matter not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Pinellas County, Florida. If you live outside the United States, you keep any protections the mandatory laws of your country give you.
17. Apple App Store terms
If you downloaded the app from the Apple App Store:
- These Terms are between you and Curvy Coder, LLC only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for any claims about the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, and intellectual property infringement claims.
- You confirm you are not in a country subject to a U.S. government embargo or listed on a U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, we have not waived it. You may not transfer these Terms; we may transfer them as part of a merger, sale or reorganization. We may update these Terms; we will change the date at the top and, for significant changes, tell you in the app. Continuing to use the Services after a change means you accept it.
